Charmify Terms of Service

1. Agreement to Use Charmify

These Terms of Service apply to Charmify, including our website and web app at https://www.charmify.me, our AI-assisted text tools, subscriptions, and any related features or services that link to these Terms (together, the Services).

Charmify is operated under the Charmify brand by Holle Kaiabe, based in Port Moresby, National Capital District, Papua New Guinea.

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use Charmify.

If you use Charmify on behalf of another person or organization, you confirm that you have authority to accept these Terms for them.

We may update these Terms when needed. Updates become effective when posted or otherwise made available through the Services. Your continued use of Charmify after an update means you accept the updated Terms.

2. Eligibility and Accounts

Charmify is for adults only. You must be at least 18 years old to create an account or use the Services.

You are responsible for keeping your account information accurate, protecting your login details, and all activity that happens through your account.

Tell us at support@charmify.me if you believe your account has been accessed without permission.

We may use authentication checks, usage limits, payment checks, rate limits, or other safeguards to protect accounts, users, and the Services.

3. What Charmify Does

Charmify provides AI-assisted text communication tools for adults. The current Services may include Drops, chat screenshot replies, contextual openers from social/profile screenshots, rewrite and tone filters, saved favorites, usage credits, paid Pro access, and related features.

Drops provides short message-style suggestions. Screenshot tools may let you upload a chat screenshot or profile screenshot so Charmify can read visible text and context, then suggest replies or openers.

Charmify does not provide matchmaking, profile discovery, user-to-user messaging, adult services, escort services, a marketplace for meeting people, or access to romantic partners.

Charmify gives suggestions only. We do not guarantee matches, replies, dates, relationships, safety, compatibility, accuracy, or any particular outcome.

You are responsible for reviewing and editing every suggestion before sending it or using it in a real conversation.

4. AI Suggestions and User Judgment

Charmify uses automated systems and third-party providers to understand inputs and generate suggestions. AI output may be inaccurate, incomplete, repetitive, unsuitable, offensive, or different from what you expected.

Generated suggestions are not instructions. You decide whether a suggestion fits the real person, context, platform rules, and situation.

You remain fully responsible for what you send to other people. Do not send a suggestion unless you believe it is respectful, lawful, consensual, and appropriate.

Charmify is not a substitute for professional advice, emergency help, legal advice, mental-health care, safety planning, crisis support, or human judgment.

5. Uploads, Screenshots, and User Content

The Services may allow you to submit text, prompts, drafts, screenshots, profile screenshots, chat messages, bios, images, favorites, feedback, or other material (User Content).

You must have the necessary rights, permission, consent, or lawful basis to upload User Content and use it with Charmify.

Do not upload private, confidential, intimate, identifying, or sensitive information unless you have permission and it is genuinely needed for the feature you are using.

Do not upload content from or about minors for dating, romantic, sexual, suggestive, exploitative, or harmful purposes.

We may refuse to process, remove, restrict, or report content that appears unlawful, unsafe, abusive, explicit, exploitative, infringing, or inconsistent with these Terms.

6. Respect, Consent, and Adult-Only Safety Rules

You may use Charmify only for lawful, consensual, respectful communication between adults.

You must not use the Services to harass, threaten, shame, stalk, impersonate, deceive, manipulate, coerce, pressure, exploit, or harm another person.

You must not use Charmify to keep contacting someone who has blocked you, rejected you, asked you to stop, or otherwise made clear that contact is unwanted.

You must not use Charmify to generate spam, scams, phishing, threats, hate, discriminatory content, abusive messages, non-consensual sexual content, or anything that violates law, platform rules, or another person's rights.

We may block, remove, report, suspend, or terminate accounts where content or conduct involves minors, exploitation, abuse, illegal content, or serious safety risk.

7. Service Limits and Misuse

You must not copy, scrape, reverse engineer, interfere with, overload, bypass, or misuse the Services or any security, billing, access, rate-limit, usage-credit, or safety system.

You must not sell, sublicense, resell, rent, or commercially exploit the Services unless we have given you written permission.

You must not use automated tools, bots, or scripts to access Charmify in a way that harms the Services, bypasses limits, or creates unreasonable load.

We may limit, suspend, or terminate access if we believe your use creates risk, violates these Terms, bypasses safeguards, causes harm, threatens the Services, or breaks applicable law.

8. Free Use, Trials, Subscriptions, and Payments

Charmify may offer limited free use, guest credits, trials, paid features, subscriptions, or other paid web app access. Features, prices, limits, renewal terms, and trial availability may change as permitted by law.

Charmify Pro launch plans may include weekly and monthly subscription options, such as a weekly plan and a monthly plan after any free trial shown at purchase. The price, currency, tax, and renewal terms shown at checkout control.

Web purchases may be processed by Dodo Payments or another payment provider. Those providers may process billing, renewals, cancellations, taxes, refunds, and payment adjustments under their own rules.

Unless stated otherwise at purchase, subscriptions renew automatically until cancelled. Cancellation usually takes effect at the end of the current billing period.

Charmify generally does not provide refunds after a purchase has been intentionally made and the paid feature, credit, subscription, or service has been used, including if you later change your mind, do not like generated suggestions, stop using the Services, forget to cancel before renewal, or are dissatisfied with a result.

We may review refund requests for accidental purchases, duplicate charges, technical billing errors, unauthorized transactions, or other exceptional payment issues. Approval is not guaranteed and may depend on the platform or payment provider used for the purchase.

If a refund, reversal, cancellation right, or charge adjustment is required by mandatory law or by the rules of the payment provider used for the purchase, that required process controls.

9. Ownership and Rights

Charmify and its software, design, branding, interfaces, prompts, workflows, features, text, graphics, logos, and other materials are owned by us or our licensors and are protected by intellectual-property and other laws.

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Services for your own lawful personal use.

You keep any rights you have in your User Content. By uploading or submitting User Content, you give Charmify and our service providers a worldwide, non-exclusive license to host, store, copy, process, analyze, display, transmit, and use that content as needed to provide, maintain, secure, troubleshoot, and improve the Services.

You also give us permission to create, use, store, and display outputs generated from your inputs as needed to operate and improve the Services, subject to our Privacy Policy and applicable law.

10. Privacy and Service Providers

Our Privacy Policy explains how we collect, use, store, share, and protect information. By using the Services, you also understand that information will be processed as described in the Privacy Policy.

Charmify may rely on third-party providers for hosting, analytics, payments, artificial intelligence, OCR, image processing, storage, communications, authentication, web distribution, security, and other functions.

Because Charmify is a global service, information may be processed in the United States, Papua New Guinea, or other places where we or our service providers operate.

11. Third-Party Platforms

The Services may link to or depend on third-party services, including payment providers, AI providers, authentication providers, analytics tools, hosting providers, and social or dating platforms.

Those third-party services may have their own terms, privacy policies, billing rules, platform rules, and support processes. We are not responsible for third-party services that we do not control.

Charmify is not affiliated with, endorsed by, or responsible for any social media platform, messaging app, profile platform, or third-party service whose screenshots or content you choose to upload unless we state otherwise in writing.

12. Service Changes, Availability, and Enforcement

We may add, remove, pause, suspend, limit, or change features, content, pricing, access, eligibility, or availability at any time, subject to applicable law.

We do not promise that the Services will always be available, uninterrupted, secure, error-free, or compatible with every device, browser, operating system, platform, or region.

We may monitor, review, restrict, remove, decline to process, suspend, or terminate content, features, or accounts where we believe it is necessary to protect users, third parties, legal compliance, our rights, or the Services.

We are not obligated to monitor every interaction and are not responsible for decisions users make outside the Services.

13. Disclaimers

The Services are provided on an as-is and as-available basis. To the maximum extent allowed by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

We do not guarantee that generated suggestions will be safe, effective, attractive, appropriate, original, non-infringing, or suitable for any particular person or conversation.

Nothing in these Terms limits any warranty, refund right, consumer protection, or other right that cannot legally be excluded under applicable law.

14. Liability Limits and Indemnity

To the maximum extent allowed by law, Charmify and its owners, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, reputation, relationships, opportunities, or personal outcomes.

To the maximum extent allowed by law, our total liability for any claim relating to the Services will not exceed the amount you paid to Charmify for the Services during the three months before the event giving rise to the claim, or USD 100 if you paid nothing during that period.

You agree to defend, indemnify, and hold harmless Charmify and its owners, officers, employees, contractors, affiliates, service providers, and licensors from claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from your use of the Services, your User Content, your violation of these Terms, your violation of law, or your violation of another person's rights.

15. Disputes and Governing Law

If you have a concern, you agree to first contact us at support@charmify.me so we can try to resolve it informally.

Unless mandatory consumer law says otherwise, these Terms and your use of the Services are governed by the laws of Papua New Guinea, without regard to conflict-of-law principles.

Any dispute that is not resolved informally will be handled in the courts or dispute forum available under the governing law, unless mandatory law gives you the right to bring a claim elsewhere.

Nothing in these Terms limits rights that cannot legally be limited under the laws that apply to you.

16. Regional Notices

Charmify is intended for global use, but these Terms do not list every country, state, province, or territory law. Users must follow their local laws, and mandatory consumer protections may apply where required.

California notice: If you are a California resident and a complaint is not resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, United States, or by telephone at (800) 952-5210.

Region-specific privacy rights, including rights for certain US, EU, UK, and other users, are addressed in our Privacy Policy where applicable.

17. General Legal Terms

We may communicate with you electronically through the Services, email, push notification, in-app message, or website notice. You agree that electronic communications satisfy any legal requirement that communications be in writing, unless mandatory law requires another method.

If any part of these Terms is found invalid or unenforceable, the remaining parts will continue in effect. We may replace the invalid part with an enforceable term that most closely reflects the original purpose.

Our failure to enforce a term is not a waiver of that term. You may not assign or transfer your rights or obligations under these Terms without our written permission. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or similar transaction.

These Terms, together with the Privacy Policy and any additional terms shown for a specific feature or purchase, make up the entire agreement between you and Charmify for the Services.
